Is sports betting legal in Nebraska?
Yes, but only in person. Nebraska allows sports wagering inside its licensed racetrack casinos, and nowhere else. The path there began with the 2020 gaming initiatives, when voters approved casino gambling at the state's licensed horse racing tracks. Lawmakers then passed LB 561 in 2021, which set out the rules for those casinos and allowed them to take bets on sporting events. The Nebraska Racing and Gaming Commission licenses the venues and writes the regulations, and you must be 21 to place a bet.
What Nebraska does not have, at least for now, is mobile sports betting. You cannot sign up with a statewide app, and none of the online sportsbooks we review is licensed in the state. If you want to bet legally today, you need to walk up to a counter or a kiosk at one of the racetrack casinos, such as WarHorse in Lincoln or Omaha.
How betting works at a Nebraska racetrack casino
Retail sportsbooks in Nebraska work much like those in Las Vegas. You choose a market from the boards or a self-service kiosk, pay in cash or with an approved payment method, and keep the printed ticket to collect any winnings. Because there is no account to log in to, guard that ticket carefully, and check the venue's rules on how long winning slips remain valid. Some casinos also offer betting apps that work only on their premises, but these are not statewide online sportsbooks. Retail counters tend to have shorter opening hours than apps, so plan ahead for early kick-offs and late West Coast games.
The November 2026 ballot: Initiatives 440 and 441
That could change soon. Two linked citizen initiatives qualified for the ballot on 3 November 2026 after supporters submitted roughly 350,000 signatures. Initiative 440 would allow online sports betting when it is conducted through vendors partnered with Nebraska's licensed racetracks. Initiative 441 would define online sports wagering in state law and require the Racing and Gaming Commission to adopt any regulations it needs by 1 June 2027.
The two measures are designed to work together, and they cover sports wagering only, not online casino games. If voters approve them, Nebraskans should not expect apps to appear overnight: the commission would first need to write rules, approve operators and test geolocation systems. We will update this page with the result and with any confirmed launch timetable once it is known.
What Nebraska bettors can do in the meantime
Until any online market launches, your legal options are the retail sportsbooks at the racetrack casinos and the online markets in neighbouring states. Iowa, Colorado, Kansas and Wyoming all permit mobile betting, and an app licensed in one of those states will work as long as your phone is physically located inside that state's borders when you place the bet. Crossing the river into Council Bluffs is the classic route for Omaha residents.
We do not recommend offshore websites that claim to accept Nebraskans. They are not licensed by any US regulator, they offer no dispute process if a withdrawal is refused, and they fall outside the consumer protections that Nebraska's own venues must follow.
Husker football, local teams and betting responsibly
Nebraska has no major professional franchise, so Cornhuskers football and volleyball carry outsized weight, along with Creighton basketball in Omaha and the College World Series every June. Whatever you bet on, set a budget before you start and treat a wager as entertainment rather than income. If gambling stops being fun, the national 1-800-GAMBLER helpline is free, confidential and available around the clock.
